These Terms and Conditions (“Terms”) govern your use of stormbook.ai and communications you elect to receive from Stormbook. By accessing or using the website, you agree to these Terms.

1. About Stormbook

Stormbook provides lead-response, appointment-booking, follow-up, automation, and related services designed primarily for roofing businesses. Information presented on this website is provided for general informational and business-development purposes. Submitting a form, requesting a Revenue Leak Audit, or communicating with Stormbook does not by itself create a client relationship or obligate either party to enter into a service agreement.

2. Revenue Leak Audits

A Revenue Leak Audit is an evaluation intended to help a business understand aspects of its inbound lead-response process. Any calculations, projections, lost-revenue estimates, conversion scenarios, or other figures presented on this website or during an audit are estimates based on assumptions and information available at the time. They are not guarantees of future revenue, appointments, sales, conversion rates, or business performance.

3. Service Agreements

If you become a Stormbook customer, your specific services, fees, responsibilities, duration, cancellation rights, performance terms, and other commercial terms may be governed by a separate written service agreement. If a separate signed service agreement conflicts with these website Terms regarding the paid services covered by that agreement, the service agreement will control.

4. No Guaranteed Results

Stormbook does not guarantee a specific number of booked inspections, a particular lead conversion rate, a specific amount of revenue, that every homeowner will respond, that every appointment will result in a completed inspection or sale, that every lead will be reachable, or any particular financial result.

Actual results depend on factors outside Stormbook's control, including lead quality, market conditions, homeowner behavior, pricing, sales performance, staffing, weather, competition, and the contractor's own operations.

5. Website Use

You agree not to use the website for unlawful purposes; attempt unauthorized access to the website or underlying systems; interfere with website operation or security; introduce malicious code; scrape or automatically extract website content in a manner that harms or burdens the service; misrepresent your identity when submitting information; or use Stormbook's intellectual property without authorization.

6. Intellectual Property

The Stormbook name, branding, logo, website design, copy, graphics, software, and other original materials are owned by or licensed to Stormbook and are protected by applicable intellectual-property laws. Nothing on this website grants you ownership of Stormbook intellectual property.

7. SMS Messaging Terms

Stormbook Messaging Program

When you separately opt in to SMS communications from Stormbook, you may receive messages concerning your inquiry, Revenue Leak Audit, appointment coordination, requested services, service updates, account communications, and other communications consistent with the consent you provided.

Message frequency varies. Message and data rates may apply.
Your wireless carrier's standard messaging and data charges may apply.

Opting Out

You can cancel SMS messages at any time by replying STOP. After you send STOP, we may send an SMS confirming that you have been unsubscribed. After that confirmation, you will no longer receive messages covered by that SMS program unless you subsequently opt in again. If you later wish to receive messages again, you may opt in again through an available Stormbook opt-in method.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Consent

Your consent to receive SMS messages is voluntary and is not a condition of purchasing goods or services. SMS consent applies only to the messaging program and sender for which you provided consent and is not transferable to another business for independent marketing purposes.

Privacy

Information collected through the SMS program is handled according to our Privacy Policy.

8. Email Communications

If you provide your email address, Stormbook may use it to respond to your request and communicate regarding services or other business matters. Where required, marketing emails will include an available method for opting out of future marketing communications.

9. Third-Party Services

Stormbook may use external technology and infrastructure providers to operate portions of its services. Your use of external services may also be subject to the applicable provider's terms. Stormbook is not responsible for outages, failures, or conduct of services outside its reasonable control.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis. Stormbook makes no warranty that the website will always be uninterrupted, error-free, secure, or free from harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Stormbook will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from your use of, or inability to use, this website. Nothing in these Terms excludes liability that cannot legally be excluded. Any additional limitations applicable to paying customers may be contained in the applicable service agreement.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold Stormbook harmless from claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the website or violation of these Terms.

13. Governing Law

These Terms will be governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute relating solely to use of this website will be subject to applicable state and federal courts having jurisdiction in Texas, unless another written agreement between you and Stormbook provides otherwise.

14. Changes to These Terms

Stormbook may update these Terms periodically. Changes become effective when the revised Terms are posted to this website with an updated effective date. Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
